📜 Terms of Service (ToS)

Welcome to SwapX ("we" or "SwapX")! These Terms of Service ("Terms") govern your access to and use of SwapX's services ("Services"), including the Official Website, Document Center, smart contracts, and related functions.

By using the Services, you agree to these Terms. If you do not agree, please do not use our Services.

1. Service Description

SwapX provides decentralized core functions:

Cross-chain Exchange: Decentralized exchange of third-party blockchain assets via third-party cross-chain bridges.
Token Purchase: Purchase tokens using supported fiat currencies (USD) through third-party providers.
Decentralized Swap: Trading based on the AMM model of XONE Chain, supporting XOC, third-party tokens, and other chain tokens.

Note: SwapX is a decentralized platform. We do not hold or control your assets. You are solely responsible for managing your wallet and private key.

2. Conditions of Use

2.1 Eligibility Requirements

You represent and warrant that you meet all of the following conditions:

You are 18 years of age or older, or have reached the legal age in your jurisdiction.
You are not prohibited from using DeFi services by any law or regulatory agency.
You are not located in a restricted region (including but not limited to the United States, North Korea, Iran, Cuba, Syria, and other sanctioned countries). For specific restricted regions, contact [email protected].

2.2 User Responsibilities

Wallet Security: You must protect your private key and wallet security. SwapX is not responsible for asset losses caused by loss or theft of private keys.
Compliance: You must comply with the laws and regulations of your jurisdiction, including Anti-Money Laundering (AML) and Counter-Terrorism Financing (CTF) requirements.
Legal Use: You are strictly prohibited from using the Service for any illegal activities (e.g., money laundering, fraud, terrorist financing).

3. Fees

3.1 Transaction Fees

Cross-chain Exchange & Swap Fees: SwapX charges a transaction fee between 0.15%–0.25%.
Gas Fees: You must pay the on-chain Gas Fees, which are determined by the respective networks (XONE Chain, Ethereum, TRON, Solana, Binance Chain, etc.). SwapX does not control Gas Fees.
Token Purchase Fees: Third-party providers may charge additional fees (refer to their Terms of Service).

3.2 Fee Adjustments

SwapX reserves the right to adjust the fee rates. Any adjustment will take effect after an official website announcement.

4. Risk Disclosure

4.1 Risks of Decentralized Services

Market Risk: Fluctuations in crypto asset prices may result in losses. SwapX is not responsible for market risks.
Technical Risk: Blockchain networks may experience failure, delay, or attacks (such as 51% attacks). SwapX is not responsible for losses caused by such failures.
Smart Contract Risk: Although the SwapX smart contract has passed a Solidity audit, there may still be unknown vulnerabilities. Users assume all associated risks.

4.2 Third-Party Service Risk

Third-Party Purchasing: Purchasing tokens through SwapX involves third-party service providers. SwapX is not responsible for their services or actions.
Blockchain Network: The Service relies on networks like XONE Chain, Ethereum, etc. Network problems may affect Service availability.

4.3 No Guarantee

SwapX provides the service on an "as is" and "as available" basis without any express or implied warranties, including but not limited to the service's availability, accuracy, or suitability.

5. Intellectual Property

5.1 Ownership

SwapX's website, smart contracts, brand logos (e.g., "SwapX"), and related content are protected by copyright, trademark, and other intellectual property laws and are owned by SwapX.

5.2 License to Use

We grant you a limited, non-exclusive, revocable license solely to access and use the Services. You may not:

Modify, decompile, or copy the Service code or content.
Use the Services for commercial purposes (unless written authorization is provided).

5.3 Open Source Code

Some code is open source on GitHub (https://github.com/hi-swapx) and subject to open source licenses (e.g., MIT License). Specific terms are available in the GitHub repository.

6. Prohibited Conduct

You agree not to engage in the following:

Use the Services for illegal activities (money laundering, fraud, terrorist financing).
Exploit service vulnerabilities or access the system in an unauthorized manner.
Interfere with the operation of the service (e.g., through DDoS attacks).
Spread malware, viruses, or other harmful code.

Enforcement: SwapX reserves the right to suspend or terminate your service and report prohibited behavior to relevant authorities.

7. Disclaimer and Limitation of Liability

7.1 No Custody

SwapX does not hold or control your assets, private keys, or funds. You are responsible for your own wallet security, and SwapX is not responsible for asset loss.

7.2 Service is provided "as is"

SwapX provides services without any express or implied warranties that the service will be uninterrupted, error-free, or suitable for a particular purpose.

7.3 Limitation of Liability

To the extent permitted by law, SwapX is not responsible for:

Losses caused by user operational errors, hacker attacks, and private key leaks.
Losses caused by blockchain network failures and Gas fee fluctuations.
Indirect, incidental, special, or punitive damages.

8. Termination of Service

8.1 User Termination

You may stop using SwapX services at any time.

8.2 SwapX Termination

SwapX reserves the right to suspend or terminate the service if:

You violate these Terms.
The service must comply with legal or regulatory requirements.
Technical or security issues make the service unavailable.

Post-Termination: After service termination, you can still access your assets through the blockchain network (subject to network rules).

9. Applicable Law and Dispute Resolution

9.1 Applicable Law

These Terms are governed by the laws of Singapore.

9.2 Dispute Resolution

Any dispute shall be resolved through friendly negotiation. If negotiation fails, both parties agree to submit the dispute to arbitration by the Singapore International Arbitration Centre (SIAC). The arbitration award shall be final.

10. Changes to Terms

SwapX reserves the right to modify these Terms at any time. Changes will be published on https://docs.swapx.exchange/study and notified via announcement or email. Continuing to use the service signifies agreement to the updated terms.
